EU Regulation 261/2004

When Does It Apply?

Flights departing from any EU country (regardless of airline)
Flights arriving in the EU on an EU-based airline
Applies to Iceland, Norway, and Switzerland too
Does not apply to flights from non-EU countries to the EU on non-EU airlines

Eligibility Requirements

Flight Delays

Compensation for delays of 3+ hours at final destination. Airline must be at fault (not "extraordinary circumstances").

Flight Cancellations

Entitled to compensation unless notified 14+ days before departure or offered suitable re-routing.

Denied Boarding

Automatic compensation if involuntarily bumped due to overbooking.

Extraordinary Circumstances

Airlines can avoid compensation for disruptions caused by events outside their control, such as:

  • Severe weather conditions
  • Security risks
  • Political instability
  • Air traffic control restrictions

Technical issues, staff strikes, and operational problems are usually NOT considered extraordinary.

Time Limits

Claims must be filed within the statute of limitations in the country where the claim is brought. This varies from 1-6 years depending on the EU member state.

Flight Delays

Cancellations

  • Choice between refund or alternative flight
  • Care (meals, refreshments, accommodation if needed)
  • Compensation (EU flights) unless notified well in advance

Baggage Issues

Compensation for baggage problems:

  • US domestic: Up to $3,800 for lost/damaged baggage
  • International: Up to ~$1,780 under Montreal Convention
